  1. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

1.1. “Pinnacle Health and Fitness” means the company, its officers, employees, agents, and representatives.

1.2. “Website” means the official Pinnacle Health and Fitness website and all content, information, or materials made available on or accessed through it.

1.3. “Programme” means any diploma, course, or module(s) offered by Pinnacle Health and Fitness, whether purchased individually or as part of a package.

1.4. “Enrolment Form” means the official document signed by the student to confirm participation in a Programme.

1.5. “Participant” means any individual undertaking a Programme, including but not limited to diplomas, modules, courses, assessments, and examinations.

1.6. “Assessment” includes written assessments, examinations, case studies, and practical assessments undertaken as part of a Programme.

1.7. “Materials” means any training resources, study aids, digital content, or documentation provided by Pinnacle Health and Fitness in connection with a Programme.

  1. Copyright and Intellectual Property

2.1. All content, information, text, images, and materials made available on or accessed through the Website are protected by copyright, unless expressly stated otherwise. Copyright ownership is vested exclusively in Pinnacle Health and Fitness.

2.2. Except as permitted under applicable national or international law, you are expressly prohibited from:
a. Reproducing, copying, or storing Website content in any retrieval system.
b. Modifying, adapting, or altering any Website material.
c. Distributing or making Website material available via any network, file-sharing system, or similar platform.
d. Creating derivative works based on the Website content.

2.3. These restrictions do not apply to materials hosted on third-party servers accessible via external links on the Website.

2.4. Requests for permission to reproduce, distribute, or otherwise use Website materials must be submitted in writing to Pinnacle Health and Fitness.

  1. Disclaimer of Liability

3.1. The information, advice, and materials provided on or downloaded from the Website are supplied for general informational purposes only.

3.2. Pinnacle Health and Fitness accepts no responsibility or liability for any direct, indirect, incidental, or consequential loss, damage, injury, or expense incurred as a result of reliance upon or use of such information or materials.

  1. Enrolment Terms and Conditions

4.1. By enrolling in a Programme, you agree that these Terms and Conditions of Enrolment form an integral part of your contractual agreement with Pinnacle Health and Fitness.

4.2. These Terms and Conditions shall not affect your statutory rights.

4.3. Prior to enrolment, you are required to confirm that you have:
a. Reviewed the current price guide;
b. Accessed relevant information available on the Website; and/or
c. Consulted with a Careers Advisor, where applicable.

4.4. While Pinnacle Health and Fitness endeavours to provide accurate guidance, the final decision regarding Programme selection remains solely your responsibility.

  1. Cancellation Policy

5.1. By signing the Enrolment Form, you acknowledge and agree to undertake the selected Programme.

5.2. You may cancel your enrolment within fourteen (14) calendar days of signing the Enrolment Form, provided the cancellation request is submitted in writing.

5.3. Upon valid cancellation, you must return all Materials in their original condition at your own expense. Failure to do so will result in a charge equal to the replacement value of such Materials. Refunds shall only be issued once all Materials are returned and verified.

5.4. No cancellations shall be accepted, and no refunds shall be issued, after the expiry of the fourteen (14) day period.

5.5. Where a Programme comprises two (2) or more modules, the Programme shall be deemed a single product. Commencement of the first module shall constitute commencement of the entire Programme.

5.6. All Programmes must be completed within three (3) years of the initial start date.

  1. Written Assessments and Examinations

6.1. Participants who are unsuccessful in their first attempt at an Assessment shall be entitled to one (1) free resubmission or retake.

6.2. Any subsequent attempts shall be subject to additional fees, as determined by Pinnacle Health and Fitness.

6.3. Failure to meet an agreed deadline for submission of a case study or examination may result in the imposition of an administration fee. The fee amount shall depend on the extension period required.

  1. Practical Assessments

7.1. For the Gym Instructor Module, you are required to provide one (1) Participant to act as a client during your assessment.

7.2. Failure to provide such a Participant will result in cancellation of the assessment. Any rebooking shall be subject to payment of an additional assessment fee.

7.3. Should you fail an assessment and wish to retake it, or elect to defer an assessment, an additional fee shall be payable.

  1. Governing Law and Jurisdiction

8.1. These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.

8.2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Enrolment Form, or any Programme.
